After a dead newborn baby was found in the freezer compartment of a refrigerator, the mother in Lower Saxony was acquitted of manslaughter charges.
According to a spokesman on Thursday, the Verden regional court was unable to determine that the baby, which was born alone by the now 33-year-old during a home birth in Achim in 2024, would have safely survived even with immediate medical treatment.
It was therefore not possible for the responsible chamber to distribute the mother for manslaughter by omission. According to the spokesman, the acquittal also corresponded to the demands of the public prosecutor and defense, who had also spoken out in favor of it in their pleadings. The verdict came on Tuesday.
Dead baby found in pizza box
The dead baby was found a few months after birth at the end of March 2025 in a pizza box in the freezer compartment of a refrigerator in the defendant’s apartment. Her mother discovered it and informed the police.
The now 33-year-old was arrested. The indictment accused her of not caring for the child after birth and thus causing its death. The defendant’s suspected drug addiction also played a role in the trial.
