Police send speed camera photo to passenger


It is clear that a triggered speed camera means a fine. But it doesn’t mean that the notice can also unexpectedly go to the person driving along.

Although authorities usually have access to vehicle data and can determine whether a vehicle is right- or left-hand drive, the photo was used without checking. According to traffic lawyer Tom Louven, such an error is unusual – but not impossible.

Proceedings discontinued due to official error

The person concerned lodged an objection and was accordingly proven right. Since the notice for the speed camera fine was addressed to the wrong person, the proceedings ultimately had to be discontinued. The authorities should have proven beyond doubt who was behind the wheel, but they were unable to do so.

Such cases show how important it is to carefully check the relevant documents yourself. A fine for a traffic violation requires that the authority or court prove that the person concerned is a driver. If a photo is used for identification, it must reliably match the person depicted with the actual driver. If this is not the case, the alleged evidence should be objected to.
