As Agnès Antich Andreu from the communications office of the Supreme Court of the Balearic Islands (Tribunal Superior de Justicia de las Illes Balears) announced on Sunday, the investigation was initiated on December 2, 2025. Investigations in Mallorca: Proceedings still at the beginning

The crucial point: In Spain, this early phase of the procedure, the so-called instruction, is not public. The investigations are carried out in strict secrecy and only those directly involved are given access.

At the same time, the justice spokeswoman emphasized to FOCUS online that the proceedings are still at a very early stage. There is currently no legal classification of the allegations by the authorities.

This creates a particular tension: on the one hand, there are significant allegations, but on the other hand, it is completely unclear whether and to what extent they can be substantiated. This is exactly what is now the subject of the ongoing investigation.

Fernandes-Ulmen case: What is known so far

According to the judiciary, the previously known allegations exclusively from the complaint itself. The plaintiff accuses the accused, among other things, of usurping identity (in Spanish: Usurpación del estado civil), betrayal of secrets, public insults, continued mistreatment and serious threats. Whether these allegations are criminally valid is currently being examined. “First of all, these are the allegations made in the complaint. The court is currently examining these,” said Antich Andreu.

Only in a later step will the public prosecutor’s office decide whether charges will be brought – and if so, for which specific offenses. Until then, the following applies: These are allegations, not established facts.

Previous procedures in 2023 were discontinued

The justice spokeswoman also referred to an earlier procedure from 2023, which was related to an alleged family dispute. At that time, investigations were started after a police operation that, according to media reports, took place at the couple’s shared apartment in Palma. In the course of this, evidence was collected and witnesses were interviewed.

In the end, the public prosecutor’s office requested that the proceedings be discontinued – and, according to the justice spokeswoman, this was granted. According to Antich Andreu, the process is now complete. The spokeswoman confirmed that this procedure was also pending at the violence against women department at the first instance court in Palma. However, she did not want to comment on what exactly happened at the time.

Divorce is confirmed

However, Antich Andreu was able to confirm that the couple’s divorce was amicable. Accordingly, office number 16 of the Civil Division of the Court of First Instance in Palma legally divorced the couple on February 18, 2026.
