Iraqi shoots at apartment – investigators let him go


In Aachen, an apartment is shot at and an Iraqi is arrested. He poses as a freedom fighter. But the public prosecutor downgraded the case and the man, who was known to the police, was released.

The Aachen public prosecutor’s office is apparently trying to cover up a judicial scandal. The authorities do not want to detain a man who apparently shot at an apartment, wanted to hit someone and who is also known to the police. In addition, the authorities refuse to communicate details about the crime and the obviously dangerous man.

The case revolves around shots fired at an apartment building on Perlisker Street in the morning hours of March 14th. The shooter apparently targeted an apartment on the first floor from which an Iranian flag was peeking out. According to FOCUS online information, the investigators secured eleven cartridge cases at the crime scene.

Some projectiles hit the target’s windows and kitchen ceiling. The house’s gas pipe was also hit. Twelve people had to be evacuated. The utility company temporarily shut off the gas. After the fire department ventilated the building, the evacuees were able to return to their apartment.

The suspect probably wanted to meet the residents of the house

Shortly after the attack, the police arrested the 28-year-old Iraqi J. near the crime scene. An empty pistol was found on him. According to FOCUS online information, the man appeared drunk. A Drug screening also confirmed that he had taken amphetamines. When arrested, the suspect explained that he was a freedom fighter in Iran. The shots are said to have been aimed at a resident who had sent a post on Instagram about the political situation of the Kurds in the region. Apparently the shooter didn’t like this entry. And so he emptied his magazine. The man admitted the crime.

The police state protectors assumed it was attempted murder and suggested that the public prosecutor’s office apply for an arrest warrant. After all, it was only thanks to a lucky coincidence that no one was injured or killed. But prosecutors refused to comply.

Conviction for resisting law enforcement officers

Rather, they downgraded the case to illegal possession of weapons and criminal damage to property. J., who is known to the authorities under a number of aliases, was released. The attacker was already being investigated for grievous bodily harm, theft and attempted murder. Apparently, however, he received no guilty verdicts. In 2019, J. was convicted of resisting law enforcement officers.

Against this background, the police forced his departure with the help of the immigration office. In order to ensure his deportation, the accused was wanted to be taken into police custody to avert danger. But the judicial request failed. Reason: There is no indication that the suspect is likely to commit further crimes. The investigators continued to observe J. But then the immigration authorities announced that a responsible district judge had rejected the arrest for deportation. The forced repatriation should take place in a regular procedure.

There is no mention of any of this in a brief press release from the Aachen public prosecutor’s office. It only says that an application for an arrest warrant was rejected. Neither the nationality of the accused is mentioned, nor his criminal history or even the findings from the investigation. “Data and personal protection,” says the spokeswoman for the public prosecutor’s office.

This is in contrast to the decree by State Interior Minister Herbert Reul (CDU), who instructed his police authorities to, if possible, also name the origin and circumstances of foreign suspects. It is not the only example from the past few weeks in North Rhine-Westphalia.
