Residential buildings have to be demolished because they are 70 centimeters too high


Three brand new residential buildings in Wolfratshausen, Bavaria, have to be demolished. Reason for this: The houses differ from the original building permit in several respects.

Two of the buildings are already empty and the last tenant plans to move out in April. The houses are scheduled to be razed to the ground by the end of April. This causes an uproar in the neighborhood.

“It’s absolutely idiotic that such a building should be destroyed”

“There are three beautiful houses with three beautiful gardens, and we have a housing shortage, that shouldn’t actually happen,” explains a resident in an interview with Sat.1 Bayern. Another thinks: “They are black buildings and some things were not adhered to, and if we were to allow that now, then it would actually be a precedent.” “I still think it’s absolutely idiotic that such a building is being destroyed,” explains another.

Double garage built instead of an approved carport

Reasons for an existing violation include, for example, the wall height being exceeded. The roof is about 70 centimeters too high. Instead of a planned one Carports A double garage has been built.

In addition, the entire property was raised and filled before construction. The district office then decided that the houses should be demolished. The owner then filed a lawsuit and proposed a restoration to the originally agreed plans. Another suggestion on their part was to use the houses as… Asylum accommodation to use.

Demolition by April 30th – otherwise there will be a fine of 700,000 euros

The Munich Administrative Court dismissed the lawsuit. “The main argument against this is that the houses are located in the so-called outdoor area, where construction is normally not allowed. In addition, the original Building permit “It has now expired because it has not been used,” explains Matthias Prinzler from the Munich Administrative Court. The deadline for demolition is April 30th. If the owner does not comply with this deadline, she is threatened with a fine of more than 700,000 euros.
